Ok, So the buyer made an offer that you have accepted and the ball is rolling...what now?

Step 1: Start with your COC's

COC’s (Certificated of compliance) are by law needed with every Agreement of sale. Without them a sale will not be registered. This will however mean that the seller needs to get an accredited company to do the relevant inspections.
Based on these inspections the seller will then be required to make certain upgrades/repairs to be compliant to the current legislation.  

Depending on which company you use a part or full portion of the proceeds may be paid by the transfer attorneys  and then settled with transfer.

Here are the different COC’s 

ELECTRICAL

This inspection has to do with the SANS10142-1 book of regulations and is by far the most complicated of the five inspections.
It also includes the occupational health and safety act and may change from time to time according to regulation.

This covers the electrical “installation” from the point of supply (Mains) to the point of consumption (plugs, sockets and switches)

This does NOT cover appliances. Only on the correctness of how these devices are connected.

BEETLE

Although there are no overall regulation this will are governed purely by the “Beetle Clause” in the specific deed of sale.
Eg: Is this applicable to the main dwelling, Whole property, wendy houses only etc.

The inspection normally comprise of a visual inspection of accessible portions of the property for Active infestation.

WATER

The official name is “Schedule for water installations”
Introduced by the “City of Cape Town” for the purpose of preserving and conserving our precious water supply.
It has little to do with the general state of your overall plumbing.

The seven main points that the plumber will check is:
1. The water cylinder complies with SANS 10252 and 10254
2. The water meter is in working order and registered
3. No water leaks on the property
4. Water pipes and terminal fittings are correctly fixed in position
5. No storm water is discharged into the sewerage system
6. There is no cross connection between potable supply and grey water or ground water
7. The private isolating valve is in place and working. Basically a stop tap must installed at the water meter.

This inspection DOES NOT include
1. Water pressure
2. Drains (free flowing vs blocked)
3. Taps and fittings that are not 100% working

GAS

LP gas pipeline installations needs to be compliant with the SABS regulations for LP gas instalations.
The following aspects are covered

1. Cylinder storage to comply with safety zones
2. SABS approved piping used and installed in the correct manner

  1. The installation of isolation and emergency valves
    4. Adequate ventilation at cylinder and inside rooms
    5. If SABS approved appliances are connected to reticulation system

6. A pressure leak test to establish the system continuity

Electric fence

To ensure that an electric fence are compliant the following are checked:
1. Wall Height needs to be 1.5m
2. Brackets – Upright brackets may be used without any height restriction
3. Angle brackets – brackets can be angled at no more than 45 degrees on the inside of the boundary wall

  1. Neighbours – Brackets may not be angled into a neighbor’s side without their written consent.

    5. Barbed or razor wire – Shall not be electrified by an energiser
    6.Hazard – no fence are to be installed and operated so that they cause no electrical hazard or entanglement
    7. Warning signs – The correct amount of signage should be displayed at the correct intervals
    8. Electrified gates – This should be 100% safe

2. Documents and payments

Declutter

Make sure that you check in with your agent as well as the transfer attorneys to ensure that there are NO documentation outstanding. 

Documentation may include:
1. FICA documents (ID, Proof of address, Fica forms)
2. House plans
3. Homeowner transfer forms

Ensure that payments are up to date. Contact the transfer attorney and let them guide you which needs to be paid when.
At the same time take note of the transfer and occupation dates.

Notify your insurance company of your address change.

3. Cancelations and transfers

Ensure that all notices have been given to: 

The buyer may be open to take over any of the current services. 
Make contact with them (through your agent) and find out about transferral instead of cancelations.
